this is the first time I have heard such a situation. as far as I know..uscis had to do either of the two things..return the package or send reciept notice. I dont think they are allowed to keep the application fees if they dont intend to process the petition.
Please check with other people..but what your lawyer is saying does not sound right to me. Have you checked with the company sponsoring your brothers H1-B? maybe they can ask the lawyer for a definite answer.
Also, did you apply under regular processing or premium processing? if it was premium processing..USCIS had to give an answer by April end.

If finance is not an issue with u or co. then renew it as a fall back. U'll never know that those guys in USCIS will do on your papers. So it is better to be safer than safe =)

For your information, most employment in the United States is "at will", which boils down to, the employer can dismiss you at any time for any, or no, reason whatsoever.
The fact that it's "retaliation" is not likely relevant.
They owe you notice of termination, or pay in lieu of notice, so a couple of weeks.

EB3 India with PD Feb 2007.
My EAD, AP and II140 are all approved because of the July Fiasco and its been more than 180 days since they all got approved.
I have my EAD and AP in hand, but I140 is with employer. I neither have a copy of it, nor the receipt number/tracking for it . All I know is that it is approved. My employer will not give it to me as it is not required by law. I am still working on H1 (haven't used EAD yet)
Recently the client I am working with asked if I would be interested in a full time with them and said I can use my EAD. Is it possible for me to take up this offer without having any details about my I140 except knowing that it is approved.?

I'm not familar with those adapters, but I've read of limited success.. Ranging from focus problems to using them completely as manual focus.
Assess what those lenses are worth now. That EF 28-80mm f/3.5-5.6 is worth $100 or so, new. To be honest, I don't think I would even mount it on a DSLR as the focal range isn't great and it's slow. The Sigma 100-300mm f/4.5-6.7 is worth $125. The same with this Sigma, it's a slow lens. So we are only talking about $225 in lenses, none are really worth trying to convert in my opinion.
Perhaps selling them on Ebay is in order. Buy the D70 with the 18-70 kit lens and your results are going to be much better than trying to use the converted 28-80. You will have focal range overlap anyways, another reason to just avoid trying with this lens.
Nikon sells a similar consumer 70-300mm f/4-5.6 that is faster and would work with the camera for $125. So if you could sell your two lenses and get $125, you would have the kit lens and this low-end zoom and be in much better shape than converting.

You have to get from your attorney or employer only. There is no other way you can get this. For joining for a new employer, the new job my be same or similar if you are using EAD / AC21 to continue GC processing.

F1 means International Student and so you are not California Resident for tuition purpose (UCs, CSUs and any state funded institution e.g. community colleges follow this practice).
Private institutions don't care, usually fee is same.
For taxation purpose, you are resident of CA and will be paying taxes on earnings.

I came to us on h4 visa . after comming here i joined a university and applied for change of status to f1 and it is approved. I am planning a trip to india. do i need to go to indian consulate for f1 visa? if i have to go wat r the chances of rejecting f1 visa? if my f1 visa gets rejected can i come back on h4 visa? is my h4 visa valid? or do i need to apply for h4 visa again? and if i apply wat r the chances of approval ? please help me i am in a tough situation. please i need ur advise. thank u :)
Since your spouse is in US on H1, do you know if she/he filed for his I-140/I-485. If so, there are chances that your F-1 visa can be rejected on the grounds of "potential immigrant" even though your I-485 is not filed. F-1 can be rejected because your spouse has shown immigrant intent which means you could be a potential immigrant as well.
Otherwise, if you have all the documents (educational background from accredited university, bank statements, valid I-20), you should get your F-1 visa without any issues. If for some reason its denied, then you can use your current valid H4 visa to re-enter US on H4. In that case, you will again roll back to H4 status upon re-entry.

OzIn Some Cases USCIS may ask paystubs before approving the H1(So be careful with company A..you need them until you get the approval notice). In case of GC, couple of months will not effect the process.
